Do we need to notify the biological father of the adoption? How difficult does this sound otherwise?

Q:   He has seen her once in 8 yrs (she was approx 2 yrs old)
His name is not on the birth certificate.
Her last name is her mothers maiden name.
She has no knowledge of his existence, he's never tried to contact her.
He lives out of state, unknown where, but we could find him if we had to.
He pays no support, and has never attempted to.


A:  David's Answer:  In this circumstance, whether formal notice of the proceeding is given to the father is discretionary with the court. That said, most of the time the court will end up requiring that notice be given.
